C-DOT has developed an easy-to-use call & chat application in the form of ‘SAMVAD’, an Android and iOS App to provide Secure solution for chat, sharing of text, image, audio and video files. The App ensures availability of data at any time with the privilege of secure and self-hosted network. The following are the Terms of Use to be adhered to by the Users regarding their usage of the Samvad App.

(Note: ‘User’ means the individual accessing, registered with or using the Service, or the company/organisations, or any other legal entity on behalf of which such individual is accessing or using the Samvad App, as applicable)

By downloading the Application and by registering or signing up to the Application, or otherwise having access to, receiving, and/or using the Application, the users acknowledge to have read, understood and agree to be governed and bound by the terms of this application:

1. The User shall provide correct, complete and accurate information while registering in the Samvad App and are responsible for the maintaining the confidentiality of the account details and password information. User shall not disclose their account information to any third party. In case of any security breach regarding their account, the user shall be responsible for the same. In addition, the user shall immediately notify their respective Organization and C-DOT.
2. The user agrees to receive verification codes via text messages to complete the registration process for Samvad App. Also, in order to enable new features and enhanced functionality, the user agrees to download and install timely updates to Samvad App.
3. The users shall not to send, host, display, upload, modify, publish, transmit, store, communicate, update or share any information in Samvad that —

• belongs to a person other than the user and the user has no authorisation /rights over the same;
• is defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
• is harmful to child;
• infringes any patent, trademark, copyright or other proprietary or intellectual rights;
• violates any law for the time being in force;
• deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
• impersonates another person;
• threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation
• contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
• is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person;

4. The users are advised to refrain from soliciting or collecting sensitive data, including but not limited to passwords, financial details, and Social Security numbers of other users in chats.
5. The users are advised to not distribute other people’s personal and confidential information, such as credit card numbers, Social Security numbers, or account passwords, without their
6. The users are advised not to send or facilitate the transmission of spam, large numbers of commercial messages, or automated messages.
7. The users are advised to exhibit caution when giving out any sensitive personally identifiable information in chats.
8. The Users agree and acknowledge that all information such as data files, written text, computer software, music, audio files or other sounds, photographs, videos or other images (Content) which user may have access to as part of, or through their use of, the Samvad Application are the sole responsibility of the person from which such Content originated. C-DOT shall not be liable under any circumstances in any manner for (a) any Content that is transmitted, uploaded, displayed or viewed by Users while using the Samvad App, (b) errors or omissions in the Content, or (c) any loss or damage of any kind incurred as a result of the use of, access to, or denial of access to Content.
9. The users shall maintain dignity in the Chats. The messages that are abusive, personal, harassing, libellous, threatening, obscene, indecent, incendiary or irrelevant shall be strictly avoided. C-DOT does not control or endorse the content, messages or information found in any chats and, therefore, C-DOT specifically disclaims any liability with regard to the chats.
10. The messages circulated in the Application by the users may contain links to other web sites/applications. Any dealings with third parties (including advertisers) included within or available via a link from the Application or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between the User and the advertiser or other third party.
11. C-DOT shall not be responsible or liable for any part of any such dealings, disclosure of information or promotions. C-DOT expressly disclaims any warranty with respect to personal or other information of user that may be collected, processed, shared or retained by any third party. When you use third-party services, their terms and privacy policies govern your use of those services.
12. C-DOT reserves the right at all times to disclose any information as it deems necessary to comply with applicable law, regulation, legal process, Judicial Order or on governmental request.
13. C-DOT retains the ownership of all proprietary rights in the Services and in all trade names, trademarks, service marks, logos, and domain names associated or displayed with the Services of Samvad App. No user shall employ any framing or passing off techniques for exploiting the marks in unauthorized manner.
14. C-DOT shall not be liable for any direct, indirect, incidental, exemplary, special or consequential damages; loss or corruption of data or interruption or loss of business; or loss of revenues, profits, goodwill or anticipated sales or savings of the users arising out of the use of the services of Samvad App.
15. C-DOT WARRANTS THAT THE SERVICES WILL CONFORM TO THE SERVICE DESCRIPTIONS UNDER NORMAL USE. C-DOT DOES NOT REPRESENT OR WARRANT THAT (i) THE USE OF SERVICES WILL BE TIMELY, UNINTERRUPTED OR ERROR FREE, OR OPERATE IN COMBINATION WITH ANY SPECIFIC HARDWARE, SOFTWARE, SYSTEM OR DATA, (ii) SERVICES WILL MEET USER REQUIREMENTS, OR (iii) ALL ERRORS OR DEFECTS WILL BE CORRECTED.
16. The user agrees to indemnify, defend and hold harmless C-DOT and its officers from any and all third-party claims, liability, damages and/or costs (including, but not limited to, attorneys’ fees) arising from their use of the APP Services, violation of these terms or the infringement or violation by the user, of any intellectual property or other right of any person or entity or applicable law.
17. This term of use is governed by the Laws of India and the Courts located in New Delhi shall have exclusive jurisdiction to adjudicate any dispute arising out of or relating to the terms of use or its formation, interpretation or enforcement.
18. The Users shall strictly adhere to the above-mentioned rules and regulations and the privacy policy of Samvad App. In case of non-compliance or violation of the terms, C-DOT shall terminate the access or usage of the Samvad App immediately. Furthermore, the Users are entirely responsible for any and all activities that occur under their account.
19. The users shall be notified in case of any updates to the Terms of use. Notwithstanding the users are also advised to check the Terms of use page from time-to-time for any such updates or modifications.

All personal data the user provides will be processed in accordance with this Privacy Statement. In this Privacy Policy, we explain what personal data or information is collected, the purpose of collection and usage of such information, disclosure of the information and the reasonable security practices and procedures exercised for safeguarding such data or information.

By agreeing to this Privacy policy, the user provides their consent to disclose their personal data. Please read the privacy statement and terms of use before registering under SAMVAD App.

(Note: ‘User’ means the individual accessing, registered with or using the Service, or the company/organisations, or any other legal entity on behalf of which such individual is accessing or using the Samvad App, as applicable.
‘Personal information’ means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person.)

By using the Application and by registering or signing up to the Application, or otherwise having access to, receiving, and/or using the Application, the users acknowledge to have read, understood and agree to the privacy policy for this application. By using this application, the user agrees to the collection and use of such personal data as enumerated under the terms below.

A. Types of Information Collected:
Samvad Account user registration requires the following personal information: i. Full name

iii. Department
iv. Organization
v. Group
vi. Designation
vii. Phone number
viii. Location
ix. Password
This data is required to provide Services to the User and for maintaining and supporting the user account.

User specific encrypted chat data is collected and stored on a secure chat server. The User’s contact list, camera, location and voice features are accessed by the App in order to provide services. The App log-in data, profile photo and profile name are collected to provide App services. The Legal basis for the processing of this data is our legitimate interest to provide services and to communicate with you.

B. Purpose of Collection and Use of Information:
C-DOT collects the personal information for the purposes of operating, delivering, improving, customizing and helping the users to access and utilize the App in an efficient manner. The data may also be collected and used for sending notices or other communications, enhancing user experience and for other legitimate purposes permitted by applicable law. The information is used to authenticate accounts and activity, detect, investigate, and prevent malicious conduct or unsafe experiences, address security threats and protect public safety.

The personal data collected is used to communicate with the user regarding the App updates and changes to terms of use and policies from time-to-time. The information is also used to respond to the user from C-DOT when contacted.

C. Information Retention:
The personal data is required to provide the app services to the User and is retained for that purpose. The information is also retained to comply with applicable law or respond to valid legal process, including from law enforcement or government agencies, to investigate or participate in civil discovery, litigation, or other adversarial legal proceedings, and to enforce or investigate potential violations of the App Terms of Service or policies.

In case of any cancellation or withdrawal of user registration, as the case may be, the information collected from the user is retained for a period of one hundred and eighty days thereafter. C-DOT will not retain personal information in identifiable form when the purpose(s) for which the personal information was collected have been achieved and, there is no legal or business need to retain such personally identifiable information.

D. Disclosure of Personal Information:
Within C-DOT, the access controls are applied to limit the recipients of personal data and is strictly restricted on a “need to know” basis. C-DOT technical staff in-charge of the Samvad Operations have access to user data as necessary for the legitimate purposes of our data retention and processing.

No personal data will be disclosed by C-DOT except as described herein or as required by law. C-DOT may share personal information in response to a request for information by a competent authority or third party if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation or legal process.

The information may also be shared with law enforcement officials, government authorities as necessary to comply with legal process or meet national security requirements; protect the rights, property, or safety of C-DOT or its users or the general public.

E. Security Practices:
C-DOT takes reasonable and appropriate steps to protect the personal information entrusted to it and treat the information securely in accordance with this Privacy Statement. C-DOT implements physical, technical, and organizational safeguards designed to protect user information from accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access.

• All the files, images, videos and other Data shared through Samvad are visible only within Samvad and are inaccessible to other Apps on the device.
• Users can take back up of their data at regular intervals and can restore it on new devices later.All the Backed-Up User Data is stored securely on the Samvad Server in the User’s Private Storage and is encrypted by User specific random keys.
• Tagged Messaging: Messages and Files can be tagged as “Confidential” or “Non-Forwardable” to sensitise the receiver and regulate the further spread of the information shared with him/ her. “Forwarded” Tag helps in Traceability & Track-ability.
• Secured Messaging: When a sender tags a message or file as “Vapour” before sending it, the message or file will be deleted from the device of the Sender and Receiver, after the Receiver reads it. The timeout period for which the message or file persist on the device after reading, can be configured by Users individually.

C-DOT strives to limit the types and categories of personal data that is collected from, and processed on behalf of, the users to include only information which is necessary to achieve the purpose(s) for which it was collected and the personal data is not used for any additional purpose(s) which are incompatible with their initial collection purpose.

The users shall be notified in case of any updates to the Privacy policy terms.
